பிற்படுத்தப்பட்டோர் இட ஒதுக்கீடு பூஜ்யம்

*மருத்துவக்கல்வி அகில இந்திய தொகுப்பு இடங்களில் பிற்படுத்தப்பட்டோர் இட ஒதுக்கீடு பூஜ்யம்*

மருத்துவப் படிப்பில் அகில இந்திய தொகுப்பு இடங்களுக்கு தமிழ் நாடு கடந்த 2013-ஆம் ஆண்டு முதல் 8121 இடங்களை தந்துள்ளது. இதில் பிற்படுத்தப்பட்டோர்க்கான இட ஒதுக்கீட்டின்படி, பூஜ்யம் இடங்களே தரப்பட்டுள்ளது.

தமிழ் நாட்டில் 69% இடஒதுக்கீட்டுக்கான சட்டத்தின்படி, பிற்படுத்தப்பட்டோர்க்கு 50% இட ஒதுக்கீடு உள்ளது. மத்திய அரசு 69% சட்டத்தின்படி இட ஒதுக்கீடு செய்திருந்தால், 4060 பிற்படுத்தப்பட்டோர் மருத்துவக்கல்வியில் மேற்படிப்பிலும், பட்டப்படிப்பிலும் சேர்ந்திருப்பர். மத்திய அரசின் சுகாதார அமைச்சகம் திட்டமிட்டு, பிற்படுத்தப்பட்டோர்க்கான இடஒதுக்கீட்டை மறுத்து வருகிறது.

*ZERO RESERVATION TO OBC:*

In all their replies (reply to Members of Parliament, reply to AIOBC Federation), the DGHS of MoH&FW has quoted a pending case in Supreme Court (596/2015 Saloni Kumari) and in their short affidavits submitted before Supreme Court of India (Feb 2016), and the High Court of Madras (June 17, 2020) mentions a proposal to implement state reservation subject to 50% ceiling and a proportionate increase in seats. The Ministry also mentions about a Supreme Court case of 2007 (Abhay Nath Case) that ordered for SC/ST reservation in AIQ seats.

But, in all these replies and also affidavits filed with Courts including the Supreme Court of India, the DGHS of MoH&FW has intentionally omitted to mention the regulations framed under the Medical Council of India Act, 1956, viz. Postgraduate Medical Education Regulation, 2000 and Regulation for Graduate Medical Education, 1997.

Both these regulations were amended and gazette notification was published on 21st December 2010 that stipulates “The reservation of seats in Medical Colleges/institutions for respective categories shall be as per applicable laws prevailing in States/Union Territories”.

DGHS is bound to implement reservation policy in the AIQ seats contributed by the States, as per the above regulations i.e. as per the reservation policy adopted in the respective States. But, it has intentionally denied for OBCs.

Thus,

1. The DGHS of Health Ministry has suppressed the above regulations before the Supreme Court of India (first affidavit of Feb 2016), before Nagpur High Court (2018) and Madras High Court (2020).

2. The DGHS of Health Ministry has suppressed the above regulations before the Parliament through its reply to Hon’ble Members of Parliament.

3. The DGHS of Health Ministry has suppressed the above regulations in the reply sent to NCBC, a constitutional body, in response to the complaint lodged by AIOBC Federation.

The matter of implementation of OBC reservation in All India Quota requires an executive action thro’ implementation of the regulations framed by the same Ministry. The DGHS and the upper caste lobby in the Central Secretariat is wilfully avoiding this and pushing the matter before the judiciary so that the matter gets delayed and ultimately get an order in their favour.

So, the solution lies not with the judiciary but with the political masters of Delhi who are silent spectators; same is the case with the OBCs, the supposed to be the largest segment of the society.

The pressure has to be built on the political stage at the All India level, seriously and immediately to make the dream of OBC reservation in Medical Admission under AIQ, a reality.

Tamil Nadu, which is always at the forefront in the fight for social justice has the duty and responsibility to unite and lead all social justice forces across the country.
